FIT FACTORY INDOOR SKATEPARK LIABILITY WAIVER
I acknowledge that my participation at Fit Factory Indoor Skatepark, located at 815 S Woodlawn, Wichita, KS, 67218, involves the inherent risk of physical injury, including but not limited to permanent disability, paralysis, and death, and property damage. I hereby assume full responsibility for and risk of bodily injury, death or property damage due to the negligence, active or passive, of Fit Factory Indoor Skatepark, its officers, directors, employees, volunteers, agents or other representatives (collectively “the Releasees”), or myself, or any other cause.
I hereby release, waive, discharge and covenant not to sue the Releasees for any and all liability, including but not limited to, any and all claims, demands, causes of action, damages, suits or judgments of any and every kind that I may have or that may hereafter accrue to me arising out of or relating to my participation at Fit Factory Indoor Skatepark.
I understand and acknowledge that this release discharges the Releasees from any liability or claim that I may have against the Releasees with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation at Fit Factory Indoor Skatepark, whether caused by the negligence of the Releasees or otherwise.
I also understand that Fit Factory Indoor Skatepark is not responsible for any lost, stolen or damaged personal property.
I represent that I am the legal parent or guardian of any minor participants listed below, and I have the legal authority to enter into this agreement on behalf of the minor. I hereby release, waive, discharge and covenant not to sue the Releasees for any and all liability arising out of or relating to the participation of the minor in activities at Fit Factory Indoor Skatepark.
I further agree to indemnify and hold harmless the Releasees from any and all claims, damages, expenses, costs, and attorneys’ fees arising from or relating to the participation of the minor in activities at Fit Factory Indoor Skatepark.
I represent that I have adequate insurance to cover any injury or damage that I may cause or suffer while participating at Fit Factory Indoor Skatepark.
I understand that this agreement is binding on me, my heirs, assigns, and legal representatives, and it applies to my participation at Fit Factory Indoor Skatepark and any activity incidental thereto, including but not limited to classes, programs, camps, clinics, private lessons, or other activities.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
